  8. Article 201: Definitions of General Application
  9.  
  10. 1.   For purposes of this Agreement, unless otherwise specified:
  11.  
  12. Commission means the Free Trade Commission established under
  13. Article 2001;
  14.  
  15. Customs Valuation Code means the Agreement on Implementation of
  16. Article VII of the General Agreement on Tariffs and Trade,
  17. including its interpretative notes;
  18.  
  19. days means calendar days, including weekends and holidays;
  20.  
  21. enterprise means any entity constituted or organized under
  22. applicable law, whether or not for profit, and whether privately-
  23. owned or governmentally-owned, including any corporation, trust,
  24. partnership, sole proprietorship, joint venture or other
  25. association;
  26.  
  27. enterprise of a Party means an enterprise constituted or
  28. organized under the laws of, or principally carrying on its
  29. business in the territory of, a Party;
  30.  
  31. existing means in effect at the time of entry into force of this
  32. Agreement;
  33.  
  34. Generally Accepted Accounting Principles means the recognized
  35. consensus or substantial authoritative support in the territory
  36. of a Party with respect to the recording of revenues, expenses,
  37. costs, assets and liabilities, disclosure of information and
  38. preparation of financial statements.  These standards may be
  39. broad guidelines of general application as well as detailed
  40. standards, practices and procedures;
  41.  
  42. Harmonized System means the Harmonized Commodity Description and
  43. Coding System, and its legal notes, as adopted and implemented by
  44. the Parties in their respective tariff laws;
  45.  
  46. measure includes any law, regulation, procedure, requirement or
  47. practice;
  48.  
  49. national means a natural person who is a citizen or permanent
  50. resident of a Party and any other natural person referred to in
  51. Annex 201.1;
  52.  
  53. originating means qualifying under the rules of origin set out in
  54. Chapter Four (Rules of Origin);
  55.  
  56. person means a natural person or an enterprise; 
  57.  
  58. person of a Party means a national, or an enterprise of a Party; 
  59.  
  60. state enterprise means an enterprise that is owned, or controlled
  61. through ownership interests, by a Party; and
  62.  
  63. territory means for a Party the territory of that Party as set
  64. out in Annex 201.1.
  65.  
  66. 2.   For purposes of this Agreement, unless otherwise specified,
  67. a reference to province or state includes local governments.

  73.                        Country-Specific Definitions
  74.  
  75.  
  76. For purposes of this Agreement, unless otherwise specified:
  77.  
  78. national also includes:
  79.  
  80.      (a) for Mexico, a national or a citizen according to
  81.  Articles 30 and 34, respectively, of the Mexican
  82.  Constitution; and
  83.  
  84.      (b) for the United States, "national of the United States"
  85.  as defined in the existing provisions of the United
  86.  States Immigration and Nationality Act;
  87.  
  88. territory means:
  89.  
  90.      (a) with respect to Canada, the territory to which its
  91.  customs laws apply, including any areas beyond the
  92.  territorial seas of Canada within which, in accordance
  93.  with international law and its domestic laws, Canada
  94.  may exercise rights with respect to the seabed and
  95.  subsoil and their natural resources;
  96.  
  97.      (b) with respect to Mexico,
  98.  
  99.      (i) the states of the Federation and the Federal
  100.  District,
  101.  
  102.      (ii) the islands, including the reefs and keys, in
  103.  adjacent seas,
  104.  
  105.      (iii) the islands of Guadalupe and Revillagigedo
  106.  situated in the Pacific Ocean,
  107.  
  108.      (iv) the continental shelf and the submarine shelf of
  109.  such islands, keys and reefs,
  110.  
  111.      (v) the waters of the territorial seas, in accordance
  112.  with international law and its interior maritime
  113.  waters,
  114.  
  115.      (vi) the space located above the national territory, in
  116.  accordance with international law,
  117.  
  118.      (vii) any areas beyond the territorial seas of
  119.  Mexico within which, in accordance with
  120.  international law, including the United
  121.  Nations Convention on the Law of the Sea, and
  122.  its domestic laws, Mexico may exercise rights
  123.  with respect to the seabed and subsoil and
  124.  their natural resources; and
  125.  
  126.      (c) with respect to the United States,
  127.  
  128.      (i) the customs territory of the United States, which
  129.  includes the 50 states, the District of Columbia
  130.  and Puerto Rico,
  131.  
  132.      (ii) the foreign trade zones located in the United
  133.  States and Puerto Rico, and
  134.  
  135.      (iii) any areas beyond the territorial seas of the
  136.  United States within which, in accordance
  137.  with international law and its domestic laws,
  138.  the United States may exercise rights with
  139.  respect to the seabed and subsoil and their
  140.  natural resources.
